So, I came across this video today: Which is a review of a new mini C64 game console. It looks really cooll, and is a very creative idea, but what bothers me is the 256 games that are included on the console. I know nothing about the developer of the device, but from the looks of it, he/she is independent. So how did they get licensing for so many top-selling Commodore 64 games? If they didn't get permission to sell these games with their device, I doin't think a project like this sheds a very good light on the retro gaming community or for legitimate products like TheC64. In my opinion, downloading decades old games that are no longer being published and using them in the privacy of your own home is one thing. Selling them is something else altogether. Am I being too critical, here?

I don't think you're being too critical, I assume this contains kernal/basic/chargen ROM's which require a license. Plus selling of the games as you say. This is where Retro Games 'do the right thing' and actual license their stuff. Of course Retro Games isn't 100% clean either, they are not fully GPL compliant as the source code they have released is missing the proper code for the NAND drivers.
Still, I've ordered the micro64, out of curiousity... Looking at the video it's probably a Raspberry Pi Zero running Combian, in a nice package.

It's just Vice Emulator and games built in...this is wrong (I like how they put it in a cassette,good idea)should not have games with it,this kind of thing kills the C64 gaming community and shearing games. "Never played Wizball on a big screen"...well get a C64 Mini or THEC64,Retro Games is helping the C64 Community not ripping it off,this is another reason to give copyright owners the reason to close rom shearing sites.
You can see they is selling the games with it cause it shows what games come with it on a big sheet,people look to see what games it got.They wouldn't buy it without them.
